That's why the August 4th date keeps getting brought up, that's the deadline for a special election to occur, otherwise we just sit and wait for the midterm in November. But he can't just appoint whoever he wants, the Republican supermajority specifically made a law against that.

And because I know what you'll say next, no, the state constitution does not allow him to appoint a US Senator. The constitution gives the governor the power to fill any vacancy at the state level or below. A US senator isn't a state-level position or below. There is talk that it could be interpreted that way, but it would certainly go through the courts and we already know how that will end, if it even ended before November anyway.
