No all shares are held by DTC , Fidelity is a beneficiary owner who passes its beneficiary rights on to you the shareholder.

will they get a letter from the DTCC saying that we’re all covered to avoid the entire point of $APE, which is essentially a share count to root out the nefarious acts of certain parties on Wall Street and beyond?

DTC will simply update Fidelities account with the proper amount of $APE based on their account holdings of $AMC. DTC will do this for all their participants. So yes DTC will either have to admit to serious fraud by not delivering shares or... will continue the fraud and hope nothing bad happens. I'm sure you can figure out which one they will choose.

Because AMC can dilute APE but not AMC.

I think maybe you need to clarify "Pursue". The closest i've seen to that is a woman who just kinda kept putting herself socially in his way so to speak until he finally asked her out. So while she may have selected him to select her back, she never once took the initiative to ask him out.
