It assumes that people are only using the middle or outside lanes to overtake, and not sitting in them driving slower than traffic. It doesn't say you have to slow down, but it says "Do not overtake on the left", which kinda implies that you do.

I don't know of anyone who's actually been fined for undertaking in these circumstances. I've also never heard what a lawyer or judge has to say about it.
