I agree with you. It can get really messy and at the end of the day there are no winners because the kids with the IEP are clearly not getting what they need and their non disabled peers aren’t able to fully access their education.

Well they need to collect data to see if the behavior plan is in place is appropriate(working by decreasing behaviors). If not they need to tweak the behavior plan and collect more data. Sometimes more support can look like less time in the regular Ed classrooms and more time in resource. At some point either the supports are going to work or the student is spending so much time in resource and still struggling with behaviors that you could reasonably say that their home school is no longer their Least Restrictive Environment and look into alternative placements. Parents can still fight that which is why it’s so important to collect data showing what you have tried and what doesn’t work. Because when you go to arbitration or court the person in charge is typically going to make you do everything possible before that change happens. So if you roll in just SAYING you’ve tried all these things but there’s no record of it you’re shit out of luck

If the school district has determined that the incident is a manifestation of the students disability they must complete an FBA and put a behavior plan into place. The district must collect data that shows their current placement is not the correct one through the plans they put in place and the data they collect. They have to have this so that when the parents try to sue the district for moving the student to a more restrictive environment, the district can back up the placement. You can’t get a vibes only change of placement. I understand the frustration it causes, but laws don’t say a student can never be moved, but the district must put in a lot of work to get it done.
